Terms and Conditions of Sale

These Terms and Conditions of Sale (the “Agreement”) govern the purchase of any puppy (the “Puppy”) from Dachshund Puppy LLC (the “Seller” or “We”) by the Buyer (the “Buyer” or “You”) through the website https://dachshundspuppy.com

By placing a deposit, making a payment, or taking possession of a Puppy, the Buyer agrees to be bound by these Terms and Conditions.

1. Purchase Price and Payments

1.1 Deposit

A non-refundable deposit of [$500.00] is required to reserve a specific Puppy. This deposit secures the Puppy for the Buyer. The deposit is non-refundable unless the Puppy becomes unfit for sale due to illness, injury, or death while still in the Seller’s care. In such a case, the Buyer will receive a full refund of the deposit or may apply the deposit to another available Puppy.

1.2 Full Payment

The remaining balance of the purchase price, plus any applicable fees (including delivery, taxes, and mandatory insurance/vet checks), is due by  7 days before the scheduled delivery/pickup date.

1.3 Failure to Pay

If the Buyer fails to pay the balance by the due date, the deposit may be forfeited, and the Seller reserves the right to make the Puppy available for sale to the general public.

2. Health Commitment and Guarantee

2.1 Initial Veterinary Examination

The Seller certifies that the Puppy has been examined by a licensed veterinarian (the “Seller’s Vet”) prior to being placed for sale and is determined to be in good health. Documentation of this examination, including current vaccinations and deworming schedule, will be provided to the Buyer.

2.2 Buyer’s Obligation (Health Check)

The Buyer must have the Puppy examined by a licensed veterinarian (the “Buyer’s Vet”) within 72 hours of taking possession. Failure to have the Puppy examined within this timeframe will void all health guarantees under this Agreement.

2.3 Congenital/Hereditary Health Guarantee

The Seller provides a guarantee against life-threatening, debilitating congenital or hereditary defects for a period of one (1) year from the date of birth or delivery.

  • If the Buyer’s Vet diagnoses a defect covered under this guarantee, the Buyer must notify the Seller immediately and provide written, certified proof of the diagnosis, including all supporting documentation and test results, within 5 days of the diagnosis.
  • The Seller reserves the right to have the diagnosis verified by a veterinarian of the Seller’s choice.
  • Remedy: If the diagnosis is confirmed, the Seller’s sole obligation shall be to offer the Buyer  (a) a replacement puppy of equal value when one becomes available, or (b) a refund of the Purchase Price (excluding fees), provided the Puppy is returned to the Seller (at the Seller’s expense) along with the registration papers.

2.4 Exclusions and Voiding of Guarantee

This guarantee does NOT cover:

  • Common conditions such as: internal or external parasites, Coccidia, Giardia, kennel cough, skin allergies, or inverted eyelids (cherry eye).
  • Any condition resulting from neglect or abuse by the Buyer.
  • Conditions treatable with routine veterinary care (e.g., ear infections).
  • Hypoglycemia in Toy or Miniature Dachshunds after 48 hours of possession.
  • Any costs associated with veterinary care, tests, or medication incurred by the Buyer.

3. Transfer of Ownership and Registration

3.1 Registration

The Puppy is sold as a pet and companion animal. If the Puppy is sold with registration papers (e.g., AKC, CKC, etc.), the Buyer agrees to register the Puppy using the designated prefix or kennel name provided by the Seller.

3.2 Spay/Neuter Agreement

If the Puppy is sold with a limited registration or “pet-only” status, the Buyer agrees to have the Puppy spayed or neutered . Proof of the procedure must be provided to the Seller. Failure to comply voids the health guarantee and may result in legal action.

4. Indemnification and Limitation of Liability

4.1 Indemnification

The Buyer agrees to indemnify, defend, and hold harmless the Seller from any and all claims, damages, liabilities, and expenses arising from the Puppy’s behavior, temperament, or ownership after the Puppy has been transferred to the Buyer.

4.2 Limitation of Liability

The Seller’s liability to the Buyer for any claim arising under this Agreement is expressly limited to the Purchase Price paid for the Puppy. The Seller shall not be liable for any indirect, incidental, or consequential damages.

5. Dispute Resolution

Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled by Binding Arbitration or Mediation administered by  American Arbitration Association, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

6. Acceptance of Terms

By proceeding with the purchase, including the payment of a deposit, the Buyer affirms that they have read, understand, and agree to all the Terms and Conditions set forth in this Agreement.
